1. Introduction
These Terms & Conditions (the “Terms”) govern your use of amberandbull.com and the Experience Economy 2.0 Intelligence platform (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
Paid research engagements and platform subscriptions are governed by a separate signed agreement. Where that agreement conflicts with these Terms, the signed agreement takes precedence.
These Terms should be read together with our Privacy Policy and our Cookie Policy.
2. Who we are
The Services are operated by Amber & Bull, a luxury boutique research firm by Jasper Colin. The contracting entity is Jasper Colin Private Limited, a company registered in New York (“Amber & Bull”, “we”, “us” or “our”).
You can contact us at sales@amberandbull.com.
3. Who may use the Services
The Services are intended for business and professional use by people aged 18 or over. If you use the Services on behalf of an organisation, you confirm you have authority to accept these Terms for it, and “you” includes that organisation.
4. Use of the website
You may browse the website and view, download or print content for your own internal business reference. You must not:
- copy, reproduce, republish, sell or distribute our content, except as these Terms allow;
- remove copyright, trademark or confidentiality notices;
- use automated tools to scrape, crawl or harvest content or data;

5. Experience Economy 2.0 Intelligence platform accounts
Access to the Experience Economy 2.0 Intelligence platform is for registered members only. Platform subscriptions are also subject to the commercial terms agreed with your organisation.
- You must provide accurate registration information and keep it up to date.
- Accounts are personal. You must not share login credentials or let others use your account.
- You are responsible for activity under your account and must tell us promptly of any unauthorised use.
- We may suspend or close an account that breaches these Terms or puts the Services or other users at risk.
6. Content you upload
You keep ownership of data and materials you upload to the platform. You grant us a limited, non-exclusive licence to host, process and analyse them solely to provide the Services to you. We treat your uploads as confidential and do not use them to train third-party AI models. You confirm you have the right to upload them and that doing so does not breach any law, contract or third-party right.
Where your uploads contain Personal Data, you are responsible for having a lawful basis to share it with us, and we will process it in line with our Privacy Policy and any data processing agreement between us.
7. Intellectual property
All content on the Services, including syndicated research, reports, data findings, videos, blogs, frameworks, methodologies, software, designs and the Amber & Bull name and logo, is owned by or licensed to Amber & Bull. It is protected by copyright, trademark and other laws.
You may quote short extracts of our published content with clear attribution to “Amber & Bull”. Any other use, including commercial reuse or publication of syndicated research, needs our prior written permission.
Ownership of custom research commissioned by a client is set out in that client’s engagement agreement.
8. Confidentiality
Syndicated research, platform data and member-only content are confidential. Members may use them only for their organisation’s internal business purposes and must not disclose them to third parties without our written consent.
9. AI-generated outputs
The platform uses artificial intelligence to help you search, synthesise and summarise research. AI-generated outputs may contain errors or omissions. They support, and do not replace, your own judgement. You should check important findings against the underlying research before relying on them.
10. No professional advice
Content on the Services is for general information and research purposes. It is not financial, investment, legal, tax or other professional advice. Research findings reflect the views of respondents at the time of fieldwork and may not predict future outcomes. Decisions you take based on the Services are your responsibility.
11. Accuracy and availability
We apply ESOMAR standards to our research and take care to keep content accurate and current. However, we do not guarantee that the Services will be complete, error-free, uninterrupted or secure at all times. We may change, suspend or withdraw any part of the Services. Where this materially affects a paid subscription, we will give reasonable notice where we can.
12. Third-party links
The Services may link to third-party websites, including social media platforms. We do not control and are not responsible for their content or practices.
13. Limitation of liability
To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of satisfactory quality, merchantability or fitness for a particular purpose. Some jurisdictions do not allow these exclusions, so some of them may not apply to you.
We are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, business, goodwill or data, arising from your use of the Services.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
14. Indemnity
You agree to indemnify Amber & Bull and its affiliated companies against claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the Services.
15. Privacy and cookies
Our Privacy Policy explains how we collect and use Personal Data, and our Cookie Policy explains how we use cookies. Please read them alongside these Terms. They are notices to you and do not form part of this contract.
16. Suspension and termination
We may suspend or end your access to the Services if you breach these Terms. You may stop using the Services at any time. Sections on intellectual property, confidentiality, limitation of liability, indemnity and governing law continue to apply after termination.
17. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and we will give platform members reasonable notice of material changes. Continued use of the Services after changes take effect means you accept the updated Terms.
18. General
If any provision of these Terms is found invalid or unenforceable, the rest remain in force. Our failure to enforce a right does not waive it. You may not transfer your rights under these Terms without our written consent. No one other than you and us has any right to enforce these Terms. These Terms, with any signed agreement referred to in section 1, form the entire agreement between us about the Services.
19. Governing law and jurisdiction
These Terms are governed by the laws of New York. The courts of New York have exclusive jurisdiction over any dispute, except that we may seek urgent relief in any court. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence.
